Boring Insurance Agency

Virginia does not let a third party sue you for serving an adult.

No statute compels it and no civil claim lies for serving an adult, so the limit is set by your lease and your contracts rather than by the law. We set the coverage up and produce the certificate — usually the same day.

What Virginia requires

Is liquor liability insurance required in Virginia?

Virginia does not require a licensee to carry liquor liability insurance. Section 4.1-222 lets the Board refuse a license to an applicant without financial responsibility sufficient for the business, which is not an insurance requirement, so carrying the coverage is a commercial decision. A lease, franchise or event contract can still require it.

Can a bar be sued in Virginia for what a customer does after leaving?

Virginia's alcohol title, Title 4.1, contains no dram shop provision. Section 4.1-304 makes it a Class 1 misdemeanor to sell to someone the seller knows or has reason to believe is under 21, interdicted or intoxicated, but no section of the title gives an injured third party a claim against the seller.

What does someone have to prove against a Virginia venue?

With no dram shop cause of action in Title 4.1, a claim against a Virginia venue has to be built on something other than the alcohol statute, most often ordinary premises liability. The criminal rule in § 4.1-304 still governs the license.

What does a Virginia bar have to get right at the point of service?

Virginia's alcohol title gives no over-service claim, so a lawsuit against a bar here is about what happened on the floor. Serving someone under 21 or someone intoxicated is still a Class 1 misdemeanor under § 4.1-304, so refusal training protects the license even where it does not prevent a suit.

Does a Virginia liquor license require insurance?

No. Virginia neither compels the coverage nor conditions the license on it.

How late can a bar serve alcohol in Virginia?

Virginia's ABC regulations stop on-premises sale and consumption from 2am to 6am in localities that have authorized mixed beverages, and from midnight to 6am elsewhere. Club licensees have no restricted hours, an exception worth naming if it applies to you, and the Authority can set stricter hours for an individual licensee.

What does a carrier do with a Virginia bar?

Title 4.1 gives no dram shop cause of action, so a claim against a Virginia venue tends to arrive as premises liability. That makes the assault and battery terms worth reading as closely as the liquor terms.

Limits

What to carry, and why that number.

Liquor liabilityOptional
Where a limit is required$1,000,000

Coverage

Two lines. Each one closes a specific hole.

Dram shop liability

Claims under state laws holding a server responsible for harm caused by an over-served patron.

Without it — A drunk driving death traced back to your bar is an uninsured claim against the business.

Assault arising from service

Injury caused by an intoxicated patron on or near the premises, where the form includes it.

Without it — The most likely late-night claim falls between the liquor and the assault exclusions.

/ What it costs, from our own book

What bars and restaurants that serve alcohol we placed in 2025 and 2026 actually paid.

These are annual premiums from policies we bound, effective January 2025 to August 2026. We show the median and the middle half of what clients paid, never the cheapest or the most expensive, and only for lines where at least five businesses stand behind the figure.

Workers compensation
$1,770median a year
Middle half: $770 to $7,650
10 policies from 8 businesses
General liability, written without property
$7,270median a year
Middle half: $5,770 to $12,690
9 policies from 8 businesses
Business owners or package policy (property and liability together)
$6,850median a year
Middle half: $5,680 to $9,960
8 policies from 7 businesses

Payroll moves workers compensation more than anything else, and the services you provide, your limits and your claims history move the rest, so treat these as a sense of scale rather than a quote. Questions

Who will actually write liquor liability in Virginia?

Realistically, a broad and inexpensive market, because the immunity removes most of the severity that prices this class elsewhere. That is a placement problem rather than a price one, and it is why a venue that has been declined twice usually needs a different submission rather than a different quote. What changes the outcome is the operating detail — hours, entertainment, the share of revenue that is alcohol, and what the last three years of losses actually say.

Does my general liability cover alcohol claims in Virginia?

No. General liability policies carry a liquor liability exclusion that applies to anyone in the business of manufacturing, selling, serving or furnishing alcohol. A restaurant with a beer and wine license has exactly the same gap as a nightclub: the premium is smaller, the exclusion is identical.

Why the premium is what it is

Is it cheaper to buy liquor liability with my general liability?

Usually, and often by a lot. Written alongside the general liability with the same carrier, liquor liability is priced as part of a package and commonly costs materially less than the same limit bought on its own. Monoline, the standalone policy, is what you fall back to when the carrier writing your GL will not take the alcohol exposure, which is exactly the situation in the harder states. So the real question is not "package or monoline", it is whether anybody will package YOUR venue. That is worth asking before you renew the two separately out of habit.

What about assault and battery? Is that covered?

Check the sublimit before you check the premium, because this is where liquor liability policies are quietly narrowed. A fight in the parking lot, a bouncer who goes too far, a patron pushed down a step. Those are assault and battery claims rather than dram shop claims, and the coverage for them is very often capped well below the policy limit.

What makes a venue hard to place, in full

What does a drunk driving claim against a bar actually look like?

It is the claim the whole coverage exists for, and it does not begin on your premises. A patron is served, leaves, drives, and injures or kills somebody who has never heard of your business. The injured party sues the driver — who is usually uninsured for the size of it — and then looks for a defendant who can pay.

We serve food as well as drink. Are we still a Virginia bar to an underwriter?

It depends on the split, and the line is lower than most owners expect. Carriers typically start asking harder questions once alcohol passes about 30 percent of sales, and many move the account onto a liquor program between 40 and 50 percent. Report the split honestly at renewal. An account rated as a restaurant that trades as a bar is an account whose claim gets investigated rather than paid.

Where a tavern sits

What will the submission actually be judged on?

Your closing hour, stated as a time rather than as "late". The share of revenue that is alcohol. Whether the room has a dance floor, live music or a cover charge. Whether door staff are employed or contracted, and licensed where the state licenses them. Camera coverage of the bar and the door. Server training certificates with dates on them. A venue that supplies all of it gets terms from more than one market, and that competition is worth more than any negotiation on a first quote.

What a bar policy has to answer for

Do I need liquor liability insurance in Virginia at all?

Legally, no — and that is a real answer rather than a technicality. Because a third party cannot sue you for serving an adult, some operators here reasonably decide to carry the risk instead of the policy, and we have clients who have done exactly that. Before you do, three things have to be checked: the minor exception still exposes you, assault and battery arising from an intoxicated patron is a different claim that liquor liability often responds to, and your lease or event contracts may require the coverage whatever the statute says. It is a decision to take deliberately with those in front of you, not a default.

We only have a beer and wine license. Do we need it?

Yes. Dram shop liability turns on serving alcohol, not on how strong it is, and the general liability liquor exclusion does not distinguish either. A brewery taproom, a BYOB with a corkage charge and a full cocktail bar all sit on the same side of the exclusion.

How is it priced?

Mainly on your alcohol receipts as a share of total sales, and on your hours. A restaurant at 15% alcohol closing at ten is a different risk from a venue at 80% closing at two, and it prices accordingly. Training records, tips or your state’s equivalent, genuinely move the number, so mention them.

Do I need liquor liability insurance to get a liquor license?

In most states the license itself does not require it, and in a few it does. South Carolina conditions the on-premises permit on it under S.C. Code § 61-2-145, and from 1 January 2026 the minimum is a $1,000,000 annual aggregate with a per-occurrence limit of at least half that, reducible to $300,000 through the state’s risk mitigation program. Utah requires dramshop coverage of at least $1,000,000 per occurrence and $2,000,000 in the aggregate for a retail license under Utah Code 32B-5-201. California requires no coverage but has required every on-premises server and manager to hold a Responsible Beverage Service certificate since July 2022. Everywhere else the requirement usually comes from your lease, your lender or an event contract rather than from the license.

South Carolina’s statutory limit, in full

What is a dram shop law?

A dram shop law lets a person injured by a drunk customer sue the business that served them. Most states have one, and the usual triggers are serving a minor or serving someone who was visibly intoxicated. A few states limit it sharply. California bars a claim against a seller for serving an adult under Cal. Bus. & Prof. Code § 25602, while Illinois allows the claim and caps the damages, at $90,411.55 per injured person for judgments on or after 20 January 2026 according to the Illinois Liquor Control Commission. Your state page sets out the statute and what a plaintiff has to prove.

What liquor liability limit does my landlord want?

Usually $1,000,000 per occurrence and $2,000,000 aggregate, matched to the general liability limit, with the landlord named as an additional insured. That is general practice rather than law, so read your lease. Some ask for an umbrella on top, and New York City leases in particular are where the limits are actually set. Buying liquor liability below your general liability limit is the common mistake, because the claim it answers tends to be the larger one.

What is the assault and battery exclusion, and why does it matter?

It removes coverage for fights, and a fight is the claim a bar is most likely to see. General liability excludes intentional injury, and many liquor policies either exclude assault and battery outright or cap it at a sublimit such as $50,000 or $100,000 against a $1,000,000 policy, sometimes with its own deductible. The certificate does not show the sublimit, so ask for it in writing before you compare two quotes at the same headline limit.

Assault and battery coverage

How does our alcohol share of sales change the price?

It is the first number an underwriter asks for. Carriers typically start asking harder questions once alcohol passes about 30 percent of sales, and many move the account to a liquor program somewhere between 40 and 50 percent. South Carolina writes a version of this into law, where keeping alcohol below 40 percent of total revenue is one of the credits that can lower the required limit. Report the split honestly, because an account rated as a restaurant that trades as a bar is a claim that gets investigated rather than paid.

Alcohol as a share of sales, in detail

How much does liquor liability insurance cost?

It depends on your closing hour, your alcohol share of sales, whether you have a dance floor, live music or door staff, and your claims history, more than on the state. Written with the general liability by the same carrier it usually costs much less than the same limit bought on its own, and that is how most bars buy it. Of the 43 restaurants, bars and caterers we placed in 2025 and 2026, two carried a stand-alone liquor policy. So we publish no stand-alone liquor figure, and the bands on this page are what our bars paid for the general liability or package policy the liquor sits on. One more figure is real. A New York City bar paying $40,000 for general liability alone was remarketed to general liability with liquor liability included for under $32,000.
