My bar was declined everywhere. Who insures hard-to-place bars?

Surplus lines carriers, reached through a licensed agent who places the account with a wholesale broker. Bars that standard programs decline are written routinely in that market: of the 16 liquor liability placements we made for bars and restaurants in 2025 and 2026, 12 went through a wholesaler to specialty surplus lines carriers. A declined bar needs one complete submission sent to the right wholesalers, not the same application sent to more direct carriers.

What to send once, to every market

A declined bar is usually declined again for a missing answer rather than for the risk. Send all of it the first time.

  1. The application, with alcohol as a share of total sales, split from food.
  2. Hours and last call, and whether you stay open past midnight on any night.
  3. Entertainment: live music, DJs, karaoke, a dance floor or promoted events, and how often.
  4. Security: who works the door, their training, and any incident log.
  5. Loss runs for five years from every carrier, including any claim you think does not count.
  6. The declines: which market declined and the reason it gave, in writing if you have it.
  7. The current policy and its expiration date, so the new one can start the day the old one ends.

The detail

  • The surplus lines market exists for "covering risks not available within the admitted market," and a "licensed surplus lines broker is responsible for ensuring the surplus lines insurer meets eligibility criteria."

  • Wholesalers quote a bar from a complete submission: the application with alcohol as a share of sales, hours and last call, entertainment and any dance floor, security, five years of loss runs, the reasons for any declines, and the current policy with its expiration date.

What this means for you

  • Stop sending the same application to more carriers. A second direct carrier usually sees the same answers and declines for the same reason. The fix is a different market, reached through a wholesaler, with the gaps in the submission filled.
  • You cannot buy from a surplus lines carrier directly. The specialty carriers that write bars take business through licensed agents and wholesalers, not from owners. Ask an agent which wholesalers they use and how many will see your account.
  • Expect to sign a surplus lines disclosure. Surplus lines policies are generally outside state guaranty funds, and states such as Florida make you acknowledge that in writing. It is a formality for most bars, and the alternative is no policy.
  • Fix what got you declined before the next renewal. The factors that move a bar out of the standard market are known and partly in your control: a dance floor, alcohol above half of sales, late hours, security and recent claims.

Related questions

Why can’t I buy directly from a surplus lines carrier?

Surplus lines carriers do not sell to the public. The account has to come through a licensed surplus lines broker, usually a wholesaler working with your own licensed agent, who confirms the carrier is eligible and files the state tax.

Is a surplus lines policy worse coverage?

Not necessarily. The forms vary by carrier, so the policy has to be read rather than assumed, and it is generally outside the state guaranty fund. For many bars it is the only coverage available, and the carriers that wrote ours are established specialty insurers.

Admitted vs surplus lines insurance
Why was my bar declined in the first place?

Usually two or three operating facts stacking: a dance floor, alcohol above half of sales, live entertainment, door security, late hours or recent claims. Our underwriting guide takes them in the order underwriters weigh them.

What makes a bar hard to place
Can you insure my bar if I was declined?

Most likely, through the wholesale market. Send the submission in the list above and we will take it to the wholesalers that write bars in your state.

Need this handled?

Reading about it and having it handled are different jobs, and the second one is ours. We place the accounts other brokers decline — claims history, a cancellation, an unusual operation, a business nobody wants to underwrite twice — and we will tell you when the policy you already have is the right one. Tell us the situation and a licensed human replies the same business day.
