What claims does this business actually get?

Almost all of them turn on identity and handling: the wrong body released or prepared, remains cremated against the family’s wishes or without proper authorisation, ashes lost or commingled, a disposition carried out before authorisation was complete. What makes them costly is not the direct loss but the emotional distress damages that follow, because there is no way to restore the position. Chain-of-custody documentation is both the defense and the thing underwriters ask to see.

Is emotional distress covered without physical injury?

This is the wording to check, and it is the whole point of the professional form in this trade. Standard general liability responds to bodily injury and property damage, and a family’s distress at a mishandled cremation is frequently neither. Funeral professional liability is written to answer mental anguish arising from the services, and a policy that does not clearly do so leaves you exposed on the most likely claim you will ever have.

What about preneed contracts?

They are a long-dated financial obligation and states regulate them tightly, usually requiring the money to be trusted or placed in insurance-funded contracts. The insurance question is fidelity: you are holding other people’s money, sometimes for decades, often with a small office team and limited segregation of duties. Crime cover sized against the trust balance is the answer, and it is regularly set at a token limit that bears no relation to the money actually held.
