Boring Insurance Agency

South Dakota will not let a guest's victim sue the wedding host. The venue contract will still ask.

Most South Dakota venue contracts name a million per occurrence and two aggregate, and that pair is what a one-day event policy is built around; a venue that wants more will say so in the contract, and a couple that reads it before buying does not have to buy twice. We set the coverage up and produce the certificate — usually the same day.

What South Dakota requires

Can I get a one-day alcohol permit for a wedding or party in South Dakota?

South Dakota special event licenses are issued by the city or county where the event is held, to civic, charitable, educational, fraternal and veterans organizations and to certain businesses that already hold a permanent alcoholic beverage license.

Can a host be sued in South Dakota if a guest drinks too much and hurts someone?

South Dakota declares consumption rather than service the proximate cause of an intoxicated person's injuries (SDCL 35-11-1) and bars civil claims against licensees (SDCL 35-4-78) and social hosts (SDCL 35-11-2), so a South Dakota event server faces no statutory over-service claim.

Is event insurance required by law in South Dakota?

The Department of Revenue's special event license page says nothing about insurance, so the limits a host carries at a South Dakota event come from the venue contract rather than from that rule.

Limits

What to carry, and why that number.

General liability, per occurrence and aggregate$1,000,000 / $2,000,000
Host liquor liabilityIncluded, at the general liability limit
South Dakota bars third-party claims against licensees and social hosts by statute, but a venue contract does not read the statute, and a guest hurt at the event itself is an ordinary injury claim the statute never touched.
Venue named as additional insuredBy endorsement, on the certificate
Nearly every South Dakota venue contract asks for the venue on the policy by endorsement, and a certificate with the venue's name typed in the description box does not satisfy the clause.

Coverage

Four lines. Each one closes a specific hole.

Third-party bodily injury

Somebody at your event is hurt and looks to the organizer.

Without it — The claim lands on you personally where there is no entity, and on the entity where there is.

Third-party property damage

Damage to the venue, the grounds, the equipment or the neighbors.

Without it — The venue bills you from the deposit and then beyond it.

Host liquor liability

Alcohol served without a license: a cash bar, a hosted drink, a supplied keg.

Without it — The base form excludes alcohol claims, and this is the one the venue is most worried about.

Additional insured status

The venue, the landowner, the city or the university added by endorsement as the contract requires.

Without it — The contract is unmet however good the coverage is, and the booking does not stand.

Questions

Can I get an alcohol permit for my wedding in South Dakota?

Not as a couple. South Dakota's special event license goes to civic, charitable, educational, fraternal and veterans organizations and to businesses that already hold a permanent license, and it comes from the city or county rather than the state. A wedding bar is therefore a licensed venue or caterer's license. South Dakota does not let a third party sue over service to an adult, but the venue contract will still ask for host liquor coverage, and a guest hurt at the event is an ordinary injury claim.

Does the venue's insurance cover me as the host in South Dakota?

No, and the contract says so. The venue's policy protects the venue, and a South Dakota venue agreement usually asks for two things from you: your own general liability limit, and the venue named as an additional insured on it. The second clause moves the venue's exposure at your event onto your policy. A guest hurt on the dance floor, a damaged wall or a claim over a drunk guest is presented to your certificate first, and the venue's insurer expects to find it there.

Can I be sued in South Dakota if a wedding guest drives home drunk?

Not easily. Two things survive that: service to a minor, which no immunity statute forgives, and the venue contract, which asks for host liquor liability whatever the statute says.

South Dakota liquor liability insurance

Does the caterer's or bartender's insurance cover my South Dakota event?

Only for the permit holder. In South Dakota the one-day license goes to an existing licensee or to a nonprofit, so at a private wedding the permit and the liquor policy behind it belong to your caterer or venue. That policy answers claims made against them. A claim against you, or the venue looking to you under its contract, is a different claim, and it lands on your event policy. Get the caterer's certificate, check it names liquor liability, and carry your own host liquor line as well.

Can I buy it for one day?

Yes, and most events do. Single-event coverage is written for the dates of the event, usually including set-up and tear-down, and it is issued quickly enough to satisfy a venue asking on short notice. If you run more than three or four events a year, an annual policy is generally cheaper and means the certificate exists before it is asked for.

The venue sent an insurance requirement. What are they actually asking for?

Almost always three things, and only the first is a number: a limit, usually one or two million per occurrence; their entity named as additional insured by endorsement rather than typed on the certificate; and often a waiver of subrogation. Send us the contract rather than the number: the wording is what gets certificates rejected, and it is the part people summarize.

Does it cover the event being cancelled?

No, and they are constantly confused. Event liability pays when somebody else is injured or their property is damaged. Cancellation coverage pays YOU back for money you have already committed when the event cannot happen. Venues require the first; the second is the one that saves your own budget, and most organizers buy only the one they were asked for.

What cancellation coverage pays for

We are serving alcohol. Is that included?

Host liquor is commonly included where you are not in the business of selling it: a wedding with a hosted bar, a company party. The moment there is a cash bar, a license, or alcohol as a revenue line, it is liquor liability proper and it is a separate coverage that the base form excludes by name.
