The individual policy, kept where it fits

An SLP in someone else's clinic, with no entity and no district contract, is well served by an individual professional liability policy from an association program, usually for a few hundred dollars. When that is the right answer we say so and leave it alone.

Without it — Moving a true solo onto a business policy buys coverage for an entity that does not exist.

The district contract

Santa Ana Unified names speech, language and vision therapists explicitly among the independent consultants required to carry sexual misconduct and molestation cover. California districts increasingly ask $3,000,000 per occurrence and $6,000,000 aggregate — Azusa Unified and Lawndale Elementary both do for work with children. Elsewhere $1M/$2M and $2M/$4M are the common asks. Read the aggregate as well as the per-occurrence number: it is the one that fails first. An individual professional liability policy does not carry that limit, and on a CPH entity policy abuse and molestation stops at $1,000,000 per occurrence and $1,000,000 aggregate — already short of a $1M/$2M ask, and nowhere near $3M/$6M.

Without it — The IEP contract does not start. This is the most common reason an SLP in private practice calls a broker.

Teletherapy and multi-state work

Remote delivery across state lines raises licensure and jurisdiction questions that a policy written for one state may not follow. Where you are licensed, where the child sits, and where your entity is formed can be three different answers.

Without it — A claim in a state the policy never contemplated, defended under the wrong law.

I have CPH. Do I already have abuse and molestation coverage?

Check before buying anything, and check the aggregate. On the individual CPH form, sexual misconduct is defense costs only — a district asking for a $1,000,000 liability limit is asking for indemnity, which is a different thing. On a CPH entity policy the coverage exists and caps at $1,000,000 per occurrence and $1,000,000 aggregate. Either way, a requirement of $1M/$2M is already beyond it and $3M/$6M is not close.
