My trucking insurance was non-renewed or my insurer failed. Who will insure me now?
A market still exists, but it is a different one, and the clock that matters is the date your current filing stops, because authority is revoked if no replacement filing is on file when the cancellation takes effect. Start the replacement the day the notice arrives, with one broker, and expect conditions such as cameras, a higher deductible or a larger down payment rather than only a higher rate.

The detail
An insurer cancels an FMCSA filing by giving 30 days’ notice on Form BMC-35, and operating authority is revoked if no replacement filing is on file when that cancellation takes effect.
Every state has a property and casualty insurance guaranty fund created by state law, which pays covered claims of a failed insurer up to the state’s legal limits, and every insurer licensed in the state to write covered lines is required to be a member.
National Conference of Insurance Guaranty Funds, Protecting Policyholders (2023)
FMCSA’s safety measurement divides a carrier’s violations by the number of power units reported on its MCS-150, so an understated unit count inflates its own scores.

What this means for you
- The filing date is the deadline, not the policy date. Find the cancellation or expiration date on the notice and on your FMCSA record. The replacement filing has to be effective on or before it, or the authority goes inactive and the loads stop.
- A failed insurer is not the same as a lapse, if you act. A guaranty fund pays covered claims of a failed licensed insurer up to the state’s limit, and it does not keep you insured going forward. Replacement coverage and a new filing still have to be bound before the old policy ends.
- Non-admitted paper has no guaranty fund behind it. Membership is required of licensed insurers only. That is one reason brokers ask about your insurer’s rating and status, and one reason to know which kind you are buying.
- CSA scores close markets before price is discussed. Markets screen on BASIC percentiles. One we place with declines automatically when more than two BASIC categories are over threshold, and others will not quote with an alert in Unsafe Driving or Hours of Service. Fixing the record matters as much as fixing the policy.
- Check your MCS-150 unit count first. The scores are divided by the power units on your MCS-150. A record still showing one truck when you run four is quietly inflating every percentile an underwriter reads.
- One broker, from the first call. A distressed account has the fewest markets, and each agency that shops it pulls the Central Analysis Bureau report. We see accounts with no market left because of the pulls, not the losses.
Related questions
- My trucking policy was non-renewed. How long do I have?
Until the date on the notice, and for your authority, until the filing’s cancellation takes effect, which is at least 30 days after the insurer notifies FMCSA. Do not wait for the last week. A distressed submission needs current loss runs, the driver list, VINs and an explanation of what happened, and assembling them is most of the time.
- Getting your loss runs quickly
- My insurance company went under. Am I still covered?
For claims, the state guaranty fund steps in for a failed licensed insurer, paying covered claims up to the state’s legal limit. Going forward, no. A liquidation ends the policies after a notice period set by state law, so you need replacement coverage and a new filing in place before then. If the insurer was non-admitted there is no guaranty fund behind it at all.
- Brokers say they will not accept my insurer because it is not A-rated. What do I do?
Read the insurance section of the broker’s carrier packet, because each broker sets its own minimum rating. Then decide whether the loads are worth moving the policy. A rated market may cost more or want more history, and changing mid-term has its own cost, so the usual answer is to plan the move for renewal and keep a list of the brokers that accept your current paper until then.
- What a carrier packet asks for
- Can I get trucking insurance with high CSA scores?
Often, though not from the markets you had. Many screen on BASIC percentiles, and some decline outright on an alert in Unsafe Driving or Hours of Service. What helps is correcting what is wrong on the record (an out-of-date MCS-150 unit count inflates every score), documenting corrective action such as a driver let go or cameras installed, and taking the account to markets that price distressed trucking on purpose.
- Why the MCS-150 has to match
- My authority already went inactive. Is it too late?
No. Binding a policy and getting its filing transmitted is what brings the authority back, and a short lapse is usually cured that way. The longer it runs the fewer markets will look, so this is the one situation where the same day matters.
- Fixing an inactive MC number
- Why does every agency I call say nobody will write me?
Because most agencies place trucking through a handful of standard markets, and a non-renewal or a CSA problem puts you outside all of them. A distressed segment exists for exactly these accounts, and it asks for conditions rather than only a rate. It also only works once. If five agencies have each pulled your Central Analysis Bureau report, the wholesalers who serve that segment may decline to look.
- What should I send you first?
The non-renewal or cancellation notice, your USDOT number, current loss runs, the driver list with license details, the VINs, and a plain account of what happened. The whole story places better than the clean one, because an underwriter who finds the part you left out stops reading.
- Why the whole story places better
Need this handled?
Reading about it and having it handled are different jobs, and the second one is ours. We place the accounts other brokers decline — claims history, a cancellation, an unusual operation, a business nobody wants to underwrite twice — and we will tell you when the policy you already have is the right one. Tell us the situation and a licensed human replies the same business day.
