Does business insurance cover mold?

Usually only when the mold follows a covered loss such as a burst pipe, and even then most commercial property policies cap it at a small sublimit rather than the policy limit. Mold from long-term leaks, humidity or deferred maintenance is excluded almost everywhere.

The leak was covered. What grew afterwards is the argument. Most policies cap that argument at a five-figure number.

The detail

  • Commercial property policies commonly exclude mold, fungus and rot, restoring limited coverage only when the mold results from a covered cause of loss.

  • Where limited mold coverage is restored, it is normally subject to a separate annual sublimit well below the policy limit.

  • Damage from continuous or repeated seepage of water over a period of days or longer is excluded by standard property forms, which is the exclusion most mold claims meet.

  • Liability claims from tenants or occupants alleging harm from mold are addressed by general liability rather than property coverage, and are themselves frequently excluded by a fungi or bacteria exclusion.

What this means for you

  • The cause decides the claim before anyone looks at the mold. A pipe that burst on Tuesday is a covered cause of loss. A fitting that has wept behind a wall for a year is the seepage exclusion, and the mold that grew is uninsured with it.
  • Speed is coverage. Drying a property within a couple of days usually prevents the growth entirely, and an insurer that sees a documented immediate response is arguing about a smaller number. A delayed report invites the argument that the loss was gradual.
  • Read the sublimit rather than the limit. Mold remediation on a commercial building routinely exceeds the sublimit a policy restores, and that figure is what you actually have.
  • The liability exposure is separate and often broader. A tenant or an employee claiming illness is a liability claim rather than a property one, so a landlord or an operator should check the general liability policy for a fungi or bacteria exclusion as well.

Related questions

My tenant says mold made them ill. Which policy responds?

That is a liability claim, so it goes to general liability rather than to the property section that would pay for cleaning the building. Many general liability policies carry a fungi or bacteria exclusion that removes exactly this claim, and buy-back coverage exists but has to be requested. A landlord relying on the property policy for this has usually misread which half of the file they are in.

Can I buy more mold coverage?

Sometimes, by increasing the sublimit or by adding a specific remediation endorsement, and the market is uneven about it. Availability and price turn on the age of the plumbing, the construction and the loss history, and a building with a previous water claim is the hardest version of the conversation.

Need this handled?

Reading about it and having it handled are different jobs, and the second one is ours. We place the accounts other brokers decline — claims history, a cancellation, an unusual operation, a business nobody wants to underwrite twice — and we will tell you when the policy you already have is the right one. Tell us the situation and a licensed human replies the same business day.
